Cycle Closet: Terms and Conditions of Hire of Bike Bags

Cycle Closet is the legal owner of the bike bag(s) provided under this agreement. For clarity, the term ‘bag’ refers to one or more bike bags as specified in the hire arrangement.

 At the time of collection, the hirer must complete the Cycle Closet Bike Bag Hire Agreement, supplying their full name, contact number, email address, and a valid photo ID. A refundable deposit of $120 is also required upon collection.

 Cycle Closet agrees to hire the bike bag(s) to the hirer under the following terms and conditions:

Use of the Bike Bag

The hirer uses the bike bag at their own risk and agrees to the following conditions:

  • Suitability: The hirer is solely responsible for determining whether the bike bag is suitable for their intended use.
  • Proper Use: The bike bag must be used responsibly, for its intended purpose, and within its designed capacity.
  • Maintenance: The hirer must, at their own cost, keep the bike bag clean, well-maintained, and in good condition throughout the hire period.
  • Cleaning: The bike bag must be thoroughly cleaned before return. Failure to do so will incur a cleaning fee of $80.00.
  • Care and Security: The hirer is responsible for the safe keeping of the bike bag and agrees to indemnify Cycle Closet for any loss or damage, regardless of cause or responsible party.
  • Liability: The hirer accepts full responsibility and liability for any injury or damage to persons or property arising from the use of the bike bag during the hire period. Cycle Closet is not liable for any such incidents.
  • Identification Labels: The hirer must not remove, obscure, alter, or damage any Cycle Closet identification tags or labels on the bike bag or associated equipment.
  • No Subletting: The hirer must not sell, lease, sub-hire, or otherwise transfer possession of the bike bag, nor assign the benefits of this hire agreement to any third party.
  • No Modifications: The hirer must not alter or modify the bike bag in any way.

Loss and Damage

  • The hirer acknowledges that the bike bag is not insured by Cycle Closet. The hirer accepts full responsibility for any loss or damage to the bike bag during the hire period, excluding normal fair wear and tear (see Fair Wear and Tear section for details).
  • The hirer agrees to cover all costs, losses, damages, and expenses incurred by Cycle Closet resulting from damage to or loss of the bike bag during the hire period. If the bike bag is lost, stolen, or damaged beyond repair, the hirer agrees to pay Cycle Closet the full recommended retail replacement cost of the bike bag.
  • The hirer is encouraged and authorised to take out insurance at their own expense for the bike bag during the hire period.
  • Furthermore, the hirer acknowledges and agrees that Cycle Closet is not liable for any damage to any bicycle transported in the hired bike bag. The hirer assumes all responsibility for any loss or damage to the bicycle or other contents carried in the bike bag and is strongly advised to arrange appropriate insurance coverage for their bike and related items during the hire.

Condition of the Bike Bag

The hirer must record any pre-existing damage or visible blemishes on the bike bag in the Cycle Closet Bike Bag Hire Agreement at the time of collection.

Fair Wear and Tear

Acceptable fair wear and tear includes:

1.   Light marks that can be removed with vacuuming or general cleaning

2.   Light scuffing, smears, or everyday debris that can be cleaned with standard methods

 

Fair wear and tear does NOT include the following:

1.   Permanent damage caused by harsh or corrosive materials

2.   Tears, cuts, scratches, holes, or burns

3.   Any damage to the structure, shape, or positioning of internal components (e.g., the seat)

4.   Hair from pets

5.   Excessive soil, mud, or sand beyond what would be expected from regular use

6.   Evidence of smoking (e.g., ash, burns, or lingering odours)

7.   Any odours or foreign substances

8.   Stains or marks that cannot be removed with general cleaning or require professional/steam cleaning

Termination

Upon termination, Cycle Closet is entitled to immediate possession of the bike bag(s). For this purpose, the hirer irrevocably appoints Cycle Closet as their attorney, authorising Cycle Closet or its agent (including Cycle Closet) to enter any premises owned or controlled by the hirer to recover the bike bag(s). 

The hirer agrees to cover and indemnify Cycle Closet against any claims, losses, damages, costs, or expenses arising from the repossession of the bike bag(s).

Failure to Return the Bike Bag

If the bike bag is not returned within seven (7) days of the agreed return date — or any extended return date agreed upon in writing between Cycle Closet and the hirer — the hirer acknowledges they will be liable to pay, upon demand, an amount equal to the full recommended retail replacement cost of the bike bag

Hire Cancellation Policy

Customers may cancel their hire reservation via email or by phone (then confirmed by email) at any time prior to the commencement of the hire period. However, cancellations are not valid unless they have been acknowledged in writing via email by Cycle Closet.

Cancellation fees apply as follows:

  • 30 days or more before the shipping or collection date:
    → A full refund of the booking cost will be provided.
  • 14 to 29 days before the shipping or collection date:
    → A 
    50% cancellation fee will be charged (i.e., 50% of the total booking cost will be refunded).
  • Less than 14 days before the shipping or collection date:
    → A 
    100% cancellation fee will apply (i.e., no refund will be issued).

Cycle Closet also reserves the right to cancel any booking at any time prior to the collection date. 

Acknowledgment of Components and Condition of the Bike Bag at Time of Hire

The agreement includes the Hirer and a Cycle Closet staff member signing acknowledgment of the list components included and a list of any pre-existing damage or blemishes at the time of collection of the bag.
